Injured Spouse From Question?

I filed my taxes jointly with my husband who did not work in 08. The refund I was expecting to get was taken due to him owing child support. I want to fill out the injured spouse form, but I read that in a community state everything is 50-50, but since he didn't work, am I entitled to get anything back from what was taken?
